Terms of Service for Frånvarokollen

Note: This is the English equivalent of the Användarvillkor (Swedish primary version). The Swedish version prevails in the event of any conflict.

1. About these terms

These Terms of Service ("Terms") govern all use of the franvarokollen.com website and Frånvarokollen's service ("Service") before a separate Software Licence Agreement has been signed.

Frånvarokollen Sverige AB, organisation number 559585-6450 with registered seat in Stockholm ("Frånvarokollen", "we", "us"), provides the Service.

By visiting franvarokollen.com, registering interest in the Service, participating in a demonstration, or otherwise interacting with our service, you accept these Terms.

2. The Service

Frånvarokollen is a software service for managing absence, substitute teacher assignment, and related analytics for Swedish compulsory schools. The Service is intended for schools' administrative staff — not for students or guardians.

The Service is used only by customers who have entered into a separate Software Licence Agreement with Frånvarokollen. User accounts are created and assigned by Frånvarokollen after the Agreement is signed — you cannot register yourself as a user via the website.

3. Relationship to other agreements

These Terms apply until a Software Licence Agreement has been signed between the Customer and Frånvarokollen. Once such Agreement is signed, the Licence Agreement supersedes these Terms entirely for that Customer.

Personal data processing is governed by:

• Our Privacy Policy — for visitors and prospective customers
• Data Processing Agreement (DPA) accompanying the Software Licence Agreement — for customers

4. Permitted use

You may use the website and any demonstration environment for the purpose of:

• Obtaining information about the Service
• Evaluating whether the Service suits your school's needs
• Participating in a demonstration with Frånvarokollen staff
• Communicating with us regarding a potential agreement

5. Prohibited use

You may not:

• Use the website or Service in violation of Swedish or other applicable law
• Attempt unauthorised access to the Service, user accounts, infrastructure, or source code
• Attempt to decompile, reverse-engineer, or otherwise probe the Service's technical structure
• Copy, distribute, or publish content from the website without our written consent (except normal use such as linking, citation with attribution, and temporary browser cache storage)
• Use automated tools (bots, scrapers) to extract large-scale information from the website
• Conduct security testing, penetration testing, or similar activities without our prior written consent
• Use the website to spread malicious code, spam, or other harmful material
• Enter or attempt to enter personal data about students, special categories of personal data under GDPR Article 9, or personal data relating to criminal offences under GDPR Article 10

6. Accounts and Service access

Access to the Service itself is granted only to organisations that have signed a Software Licence Agreement with Frånvarokollen. User accounts are created by Frånvarokollen after:

• Signed Software Licence Agreement
• Signed Data Processing Agreement (DPA)
• Customer's designation of a coordinator as primary contact

You cannot self-register a user account via the website.

For demonstrations or evaluation periods, temporary accounts may be provided. Such accounts are governed by these Terms until a Software Licence Agreement is potentially signed.

7. Intellectual property

Frånvarokollen Sverige AB owns all intellectual property in the website, the Service, the "Frånvarokollen" trademark, logos, design, source code, documentation, and all other content.

Nothing in these Terms transfers any intellectual property to you.

You may link to franvarokollen.com in reasonable ways without specific permission, provided the link does not create misunderstandings about the relationship between you and Frånvarokollen.

8. Personal data and cookies

Our processing of personal data is described in our Privacy Policy.

Our use of cookies is described in our Cookie Policy.

The franvarokollen.com website currently uses no cookies.

9. Availability and changes

The website and any demonstration environment are provided "as is". We aim for high availability but make no guarantees that the website is free from errors, interruptions, or security issues.

We may at any time:

• Update, modify, or remove content on the website
• Change the Service's functionality or appearance
• Temporarily or permanently suspend access to parts of the website or demonstration environment
• Update these Terms per Section 14

10. Limitation of liability

The website and any demonstration access are provided free of charge and without warranties.

Frånvarokollen's total liability to you in connection with your use of the website or any demonstration access under these Terms is limited to one thousand (1,000) SEK.

Frånvarokollen is not liable for:

• Indirect damages, consequential damages, loss of profit, lost business opportunities, or damage to reputation
• Damages resulting from your own equipment, internet connection, or software
• Damages resulting from your breach of these Terms
• Content on external websites linked from franvarokollen.com

This limitation does not apply to:

• Damages caused by Frånvarokollen's gross negligence or wilful misconduct
• Liability that cannot be limited under Swedish law

For Customers who have signed a Software Licence Agreement, liability is governed by that Agreement and this Section 10 does not apply to that relationship.

11. Indemnification

You agree to hold Frånvarokollen harmless from claims, damages, losses, and costs (including reasonable legal costs) brought by third parties against Frånvarokollen and arising from:

• Your use of the website or demonstration environment in breach of these Terms
• Your breach of applicable law or third-party rights
• Prohibited use under Section 5

12. Confidentiality during demonstrations

Information you receive access to during a demonstration of the Service — including non-public functionality, performance, roadmap, or pricing — is confidential.

You may not:

• Disclose such information to third parties without our written consent
• Publish screenshots, videos, or other documentation of the demonstration environment on public forums (social media, public websites, conferences etc.) without our written consent

This obligation applies even if no demonstration leads to a signed Software Licence Agreement.

13. Links to external websites

Franvarokollen.com may contain links to external websites. We are not responsible for content, availability, or personal data handling on such external websites. You follow the link at your own risk.

14. Changes to these Terms

We may update these Terms. The current version is always published at franvarokollen.com/terms with the date of last update.

For material changes:

• We provide clear notice on the website
• We update the "Last updated" date at the top

By continuing to use the website after a change, you accept the updated Terms.

15. Governing law and disputes

These Terms are interpreted and applied under Swedish law, without applying its conflict-of-law rules.

Disputes that cannot be resolved by agreement are decided by Stockholm District Court as the court of first instance.
